my (biased) opinion is that in light of applications to the SC, the way forward may now have 'changed' 

 

Thus Tekkies lawyers were against having the initial Case Flow Judge being part and parcel of the upcoming 'reorganization' as he might agree that as a result of the application to the SC, the liquidation case cannot proceed.

With all the new applications that have been made to the SC, the court now needs to review proceedings and the way forward.

Caseflow management is the court supervision of the case progress of all cases filed in that court. It includes management of the time and events necessary to move a case from the point of initiation (filing, date of contest, or arrest) through disposition, regardless of the type of disposition.

 

Basically, its just organizing ones kitchen again after a saturday braai with friends

First no judge, then the attorneys went for a chat into a seperate room and minutes later the hearing was called off.  :D Early Christmas...???

Why so?..Perhaps called off due to the appeal to the SCA?

Agree. The more I get to know, the less sympathetic I have become.  Maybe the Judge should take the TT boys on a weekend away - won't like them much after that.

I suspect there is still a lot of fear priced in to the markets.  When there is more clarity on the TT proceedings - I think it will trigger more significant movement - upward or downward, depending on what the outcome is.  This is a major lesson in the psychology of investment.

And, according to the interview the TT boys have forgiven Jooste!! Really? WTF!! This reveals so much about them. Here they are, trying to liquidate an entity yet they have forgiven the architect of this alleged fraud!!!!
SNH is an entity not a person and as such, like any company, is incapable of committing fraud - it is the people (ie management - the human factor) who cause the fraud or irregularity. A company in and of itself, without humans, is incapable of committing fraud.
They should ask themselves, if Jooste had not been at SNH - would this alleged fraud have taken place? Absolutely not.

It's like forgiving the robber who stole all your money but then suing Avis because their rental car was used in the robbery.

SNH was merely the device Jooste used to pull this all off. These TT yo-yo's need to stop peddling this tiresome "victim" song about how ruthlessly they were fleeced by SNH - Absolute drivel and the thankfully, some people in the media are starting to pull this TT fairytale story apart. As long as these guys and Jooste can sing kumbaya around a campfire, staring lovingly into each others eyes, the rest of the claimants, employees and anyone else affected by a liquidation - can go and get stuffed - really?

My only concern is that I have little faith in any state controlled entities and as we know, the judiciary in this country is a joke - making the outcome of this case a lot less predictable than it should be. Over-zealous egotistical judges desperate to make a name for themselves in such a high profile action.
