Also the Lancaster/Naidoo vs SARB/Steinhoff case. After today I doubt if the SARB can upkeep (expires 30.11.2021) or renew the approval for the cross-border transfer. Like DTD said, Steinhoff might have to use another purse now...

Interesting this is not over yet:

 

The retailer was hoping the settlement would draw a line under the mass of litigation it has been facing since its stock price plunged in late 2017.

 

In his judgment, Bozalek implied that he would likely hear further arguments around how his ruling would impact the settlement proposal, which he said may be "revisited following this judgment".

 

Claimants had not yet voted on the settlement proposal and Bozalek said it has "some way to go before it can be sanctioned by a court".

 

"Before that stage is reached the applicants will have adequate opportunity to voice their opposition to any such proposal or interdict any prior payments which they regard as unlawful," he said.

 

Steinhoff said on Friday afternoon that it was "considering the implications of the judgment", and would provide an update in due course.

Not sure for the panic we are talking about a loan of Eur 1.2 bil if I am correct. So it i very clear one more time LDP and his team did a excellent job and planned for this event. SNH has the cash from the listing of PEPCO so they simply will pay and the problem gone!!!

Squid how concerned are you?

I am not a lawyer but I would say that SNH could be in deep kak. Search the internet for details of Section 45. I had some other Section 45 cases a few weeks/months ago, but already deleted them from my PC.

I guess Trevo, Hamilton & Co might be able to take them to the cleaners...Even Tekkies and their case in September will be in a new light...

What does this judgement mean and how will it affect Steinhoff's Global Settlement Proposal - I quote from the SENS:

'Steinhoff Board Resolutions authorizing entry into the SIHPL CPU are void in terms of Section 45 of SA's Companies Act'

 

Is the entire process flawed now or does it imply that Trevo and Hamiltons can now re-negotiate a better settlement?

34 million shares changed hands within an hour of that news breaking… It’s all part of a process… maybe the one judge erred and the next on appeal will correct… this was never meant to be a straight upside growth trajectory
